- Ohio is a FULL PRICE lien state.
- Prior to the start of construction, a private project owner is required to file a Notice of Commencement with the County Recorder(s) for the county or counties where the project is located. The public authority’s obligation is to keep the Notice of Commencement-Public on file and to make it reasonably available to the public.
- A Notice of Commencement is not required on residential construction (one and two family dwellings).
- Failure of the owner to file a copy of the notice of commencement or to provide a copy of the notice of commencement, upon request, within 10 days, extends the notice deadline to 21 days from compliance.
- A late notice will trap unpaid funds provided 21 days prior to serving the notice.
- Liens must be served on the contracting party or owner’s designee within 30 days of the date that the Lien was filed with the County Recorder.
- Generally, a materialman may count their lien time from the date that the material was delivered to the project. Where the material is being delivered to the project via a common carrier, the lien date is calculated from the date the material is delivered to the common carrier.
